Like nearly every other state, Virginia relies on a set of factors outlined in its code (Virginia Code § 20-124.2) to determine custody that is in the best interests of the child or children. Child Support
Child support may be reserved to the parents, ordered by a court, or agreed to by the parents, but it cannot be waived. Virginia courts rely upon guidelines provided in § 20-108.2 of the Virginia Code to determine a presumptively adequate child support amount. Parents can request to deviate if the amount seems too much or too little, but § 20-108.2 is a good starting point.
